Kaduna state High Court has fixed August 5, for the hearing of preliminary objection, by Minister of Federal Capital Territory (FCT), Bala Mohammed and six others, asking the court to strike out a case filled before it by Publisher of Kaduna based Desert Herald Newspaper, Malam Tukur Mamu.

Tukur Mamu has dragged the FCT Minister and six others before Kaduna State High Court for alleged defamation of character and malicious prosecution.

Meanwhile, in his preliminary objection, Counsel to the Minister,

Nnamdi B. Nweke said Tukur Mamu has filed a case that, Minster of Federal Capital Territory (FCT), Bala Mohammed has defamed him, claiming N50million. His second claim is that, he is being maliciously prosecuted by the Minister.

He said they were surprised that he filed the matter in Abuja and later withdrew it and came and filed it again in Kaduna, while the purported defamation and the malicious prosecution supposedly took place in Abuja.

He continued that, the law is very straight forward and they had no nreason to be in Kaduna.

“That is the reason we have filed our preliminary objection, asking the court to strike out the matter accordingly. Now, the court has fixed 5th of August fort the hearing of the preliminary objection”, he explained.

However, Counsel to the Plaintiff, Abdul Mohammed declined comment of the issue outside the court, even though he did not object the move by the other party for adjournment to allow the court hear the preliminary objection.

According to him, “The matter is in court and as a matter of personal principle, once a matter is in court, I don’t discuss it with the press.

The case, presided over by Justice Lawal Bello, was however adjourned to 5th August, 2014 for the hearing of the preliminary objections.
