Niger: Tafa LG chair, Abubakar kicks as court sacks him

A High Court sitting in Minna has restrained the Tafa local government chairman, Alhaji Abubakar Ado (1st defendant) from parading himself and ordered the All Progressive Congress (APC) from recognizing him as chairman of the council.
The Court presided over by Justice Aisha Bawa Bwari in the judgement on 26th January, 2018 Suit No. NSHC/SD/52M/2015 further ordered the 3rd defendant (Niger State Independent Electoral Commission) to restrained from recognizing and treating the 1st defendant as the chairmanship candidate for Tafa local government held on November 2015.
It has mandated the second respondent to conduct the primary election for its chairmanship candidate in Tafa local government with delegates from Garam and Dogon- Kurmi wards voting in the election hence the purported primary was declared inconclusive by the Electoral Committee.
According to Justice Bwari said “Upon hearing originating summons brought pursuant to order 3 rule 7 (1) & (2) of the Niger State High Court Civil Procedure Rules 2012, section 87(4) (d) of the Electoral Act 2010 (as amended) and under the inherent jurisdiction of the Honourable Court dated 17/9/2015 and filed 22/9/2015 supported by 32 paragraph affidavit, deposed to by Mami Ibrahim Ijah (plaintiff)”.
It has also ordered restraining 2nd defendant from submitting the name of any person howsoever or described to the 3rd defendant as it’s chairmanship candidate for Tafa local government election without concluding the chairmanship primary election which was declared inconclusive by the Electoral Committee.
The Court, however, awarded a sum of N50,000:00k for the plaintiff against the 1st and 2nd Defendants jointly and severally.
The plaintiff Hon. Ibrahim Mami Ijah in an interview applauded judiciary as the last hope for a common man, his counsel Barrister Chris Osuagwu and President Muhammadu Buhari for putting the judiciary on it toes and dedicated the victory to God.
Ijah urged the people of his council to remain calm, patient and peaceful as they await the authorities concern to implement the court judgement hence God will surely answer their prayers.
The 1st defendant according to reliably source disclosed that he has gone to Appeal Court in pursuant of the case against the Minna High Court judgement.
