Ndokwa West Constituency Seat: Parties Adopts Final Addresses At Tribunal

The Delta State House of Assembly Election Petition Tribunal sitting in Asaba on Thursday adopted final addresses by parties in the case in which,Ozegbe Godswill Adoh of African Democratic Congress ( ADC) is Challenging the election of Charles Chukwuemeke Emetulu of the People’s Democratic Party (PDP) for Ndokwa West Constituency Seat.
The first respondent’s Counsel,Barr Michael Onyarin in his address decleared that the documents tendered by the first respondent was self evidence and urged the tribunal to dismiss the petitioner’s petition.while Barr Ihede Ehidegua, Counsel to the second respondent,. Called on the tribunal to adopt his final written address in Support of the second respondent’s arguments and in opposition to the Petitioner’s Claims.
Barr Ehidegua maintained that the Petitioner went outside the statutory 14 days allowed to file their response and urged the tribunal to strike out every evidence given outside the 14 days, and also contended that the Petitioner’s witness did not challenge results from ward one and also confirmed that he did not know what happened in their wards.
Barr Isaiah Bozimo Counsel to the third respondent, cited the Appeal Court Judgement on Udeagha and Omoghare 2010 and Urged the tribunal to dismiss the petition in its entirety
The Petitioner”s Counsel in the Suit number EPT/DT/SHA/44/2019,. Barr Emmanuel Uti in his Subsmission,posited that there were malpractices as demonstrated by the 14 witnesses Called and the documents tendered by the Ist respondent, stressing that the first respondent did not call any witness in the course of trial..
But Barr Uti further averred that the only witness Called by second respondent told the tribunal that he could not vouch for the results Present by the Independent Electoral Commission’,(.INEC) while the witness Called by the third respondent wins the election.
He therefore Urged the tribunal to grant the reliefs sort by the Petitioner
The tribunal Chairman, Justice Emmanuel Ngene after the adoption of the final written addresses by the Parties, and thanked them for the Camaraderie that existed among the Parties in the course of trial and informed that they will be duly Communicated when the date for judgement is fixed.
