DPP clears Benin chief priest of alleged murder case

The Department of Public Prosecution (DPP), Edo state has cleared the Chief Priest of Ohovbe Community in Ikpoba-Okha Local Government Area of the state, Joseph Amadasun and another suspect arraigned and remanded in prison custody last week.
Counsel to the 3rd and 4th accused persons, Joseph Amadasun, the Chief priest of Ohovbe Community and Osazee Edomwonyi, Barr. Kingsley Owie, disclosed this after he secured the release of his Clients at the Oko Prison in Benin City.
The accused were earlier remanded in prison custody last week by an Ogbeson Magistrate Court sitting in Benin over an alleged attempted murder on one Yusuf Sule a resident in Ohovbe Quarters, Ikpoba Okha Local Government Area of Edo State.
Chief Amadasun, 54, and three others were charged on a seven count charge bordering on attempted murder, unlawful shooting, breach of peace, threat to life and unlawful assault on Yusuf Sule and Anapi Saleh.
The Magistrate, Mrs. Taye Omoruyi, had remanded the accused persons to prison custody pending on DPP’s advice and adjourned to 13th February, 2018 for mention.
Giving the reason the accused persons were not earlier granted bail, Barr. Owie, said the offenses were lumped up and that the magistrate needed time to study it bit by bit.
“I am representing the accused persons in the above mentioned charge. On that fateful day, the first and second accused persons were charged with the offenses that are not bailable in nature while the third and fourth were charged with offenses that are bailable in nature but the chief magistrate presiding was handicap because the charge sheet was lumped together.
“And in that respect, she could not grant bail to the third and fourth accused persons even when I raised the objection that my lord could exercise her discretion.
“She then told the court that since the offenses were lumped together, it is advisable she refers the case to DPP.
“And even when the case was refer to DPP, we took steps to ensure that the DPP look into the case file and that resulted to the DPP coming up with its legal opinion that the second, third and fourth accused persons do not have any case to answer except the first accused person”, he said.
