A Federal High Court sitting in Makurdi and presided over by Justice Joseph Aneke yesterday struck out a suit brought by Public Complaints Commissioner Alhaji Abubakar Tsav’s against Oracle Business Limited, Oracle Farms Ltd, Oracle Media Ltd, Oracle Feeds Ltd, Goshen Water Ltd and Mr Michael Ortom.
The suit hinges on fundamental rights filed by Alh. Tsav against the Benue State Government, the Attorney General of Benue State, Mr.Mike Gusah and 8 others.
When the matter came up for hearing, Counsel to Alhaji Abubakar Tsav, Mr Anthony Agadah informed the Court that his client wants to discontinue the suit against the 3rd – 10th Respondents.
Counsel to the 3rd-10th Respondents, Mr S. E. Irabor asked the court to grant his clients the cost of N10 million for the incessant harassment over a suit which the court does not even have jurisdiction to entertain.
Mr Irabor urged the court that in addition to the names of his clients been struck out, the court should activate Order 13, Rule 2 of the Fundamental Rights Procedure Rules, 2009 by making an amicus curiae use of the Preliminary objection he had earlier filed and rely on same in dismissing the suit in its entirety.
Justice Aneke granted cost of #50,000 against Alh. Abubakar Tsav and adjourned the matter to the 20th of March, 2018 for the adoption of written addresses on jurisdiction by the other parties.
Responding to the proceedings, Counsel to both Benue State Government and the Attorney General of Benue State, Mr Andrew Wombo told Journalists that the case was dead on arrival, as the Federal High Court does not have jurisdiction to entertain the matter.
