Court restrains Uba from parading as Speaker

A Makurdi High Court presided over by Justice Theresa Igoche yesterday restrained the new speaker of the Benue State House of Assembly Mr. Titus Uba from parading himself as Speaker of the assembly.
This followed an exparte motion brought by counsel to the former Speaker Terkimbir Ikyange Chief Mamman Osuman, SAN, seeking reliefs restraining the Uba led faction from parading themselves as principal officers of the House
Ruling on the motion, Justice Igoche held the reliefs of counsel to Ikyange and restrained 1st- 5th defendants/respondents which include; Speaker Titus Uba, Deputy Speaker Johnson Egli Ahubi, Majority Leader Rt. Hon. Avine Agbom, Deputy Majority Leader Sule Dickson Audu, Chief Whip Kester Kyenge as well as the clerk Dr. Torese Agena from entry and conducting any sitting in the assembly complex pending determination of motion on notice.
“I give an order of this honorable Court restraining the 1st-5th Defendants/Respondents from entering and /or further entry and occupying the offices of the 1st-4th plaintiffs/applicants that is Speaker,Deputy Speaker,Deputy Majority Leader and Chief Whip”
The presiding Judge further noted that “upon hearing from Chief M. M. Osuman SAN, for the applicants, the Court held as follows: I have read the motion No. MHC/1694m/18 filed on 10 August, 2018, together with the other process accompanied it. Particularly, I have looked at paragraph 22-34 of the affidavit in support and paragraphs 5-13 of the affidavit of urgency”
According to her, “this Court takes Judicial notice of the Order of interim
Injunction made against the plaintiffs/ applicants on 1st August, 2018 in suit No.MHC/259/18”
Justifying the restraining orders, Justice Igoche said in her opinion, “it is necessary for the purpose of averting any danger that may be caused and to avoid any breach of the peace, that this application be granted so that the members of the Benue State House of Assembly will not sit in the 5th Plaintiff/applicant(s) Assembly Complex until the motion on notice is heard and determined”
