Court nullifies appointment of village head in Gwagwalada

An Abuja high court sitting in Maitama, in the Federal Capital Territory (FCT) has nullified the appointment of the village head of Anguwan Geshi, in Gwagwalada area council, Mallam Musa Abubakar.

Peoples Daily reports that the court appointment of Abubakar as the village head of the community, following a suit instituted against him by one Mallam Mohammed Madaki, on October 9, 2007, challenging authorities of the administration of Gwagwalada area council in the matter.

Delivering the Judgement, Justice Mwada Balami, Balami said that there was no law that empowered the chairmen of any area council within the FCT to appoint a Chief or traditional ruler in the territory.

He explained that by the virtue of section two (2) of the chiefs appointment and the disposition of the Federal Capital Territory (FCT) Decree 1997, the only authority vested with the power to appoint a chief/traditional ruler was the minister of the Federal Capital Territory.

He therefore, instructed the authority of Gwagwalada area council to follow due process for the appointment of any traditional ruler or chief in the council.
