Court dismisses suit against IGP, claimant to pay cost

A High Court Sitting in the Federal Capital Territory, Presided over by Justice Jude Okeke, of Court 15 has dismissed a suit instituted by one Alhaji Nuhu Anaja against the Inspector General of Police, IGP, Ibrahim Idris, Commissioner of Police FCT, and Commissioner of Police (PSFU) Area 10, as the 1st, 2nd and 3rd Respondents respectively, seeking an order for the enforcement of his fundamental rights.
Nuhu was seeking an order restraining the respondents and their agents from further arresting, detaining harassing, intimidating, inviting, molesting and or interfering with his rights on grounds of any allegation of criminal conspiracy, threat to life and forgery in a petition written by one Fortune Chinemerem to the police, until the
determination of suit No: FCT/CV/28877/17, before the High Court of the FCT.
He was also seeking an order of the court against the respondents jointly and severally to pay him the sum of N10, 000, 000:00 only as general and specific damages for wrongful arrest, illegal detention and breach of his fundamental rights.
Challenging the suit, counsel to the, IGP, Barr Clement Oji Chinaka argued that the Police have statutory duties outlined both in the constitution and Police Act and quoted relevant sections to buttress his contention.
Justice Okeke, after listening to the arguments dismissed the application with suit No: CV/0191/ 2017, and awarded a cost against the claimant to the tune of N30,000 .00.
