Bauchi State High Court number two presided over by Justice Aliyu Musa Liman has granted bail to a 30 year- old man, Umar Mohammed after he spent six months in prison and the prosecution counsel were not able to provide a single witnesses to testify in court.
Justice Liman granted the bail of the accused at the sum of N250, 000 or two sureties in like sum, and one of the surety shall be the village head or a director employed by the Bauchi State Government.
Umar was arraigned before the court by the State Ministry of Justice over allegedly raping 13 year old girl in Azare headquarters.
Prosecution counsel, Aliyu Shehu told the court that the accused lured Walida Mohammed a student Pof Junior Secondary School Azare into his friend’s room and had sexual intercourse with her without her consent while she was hawking soup stuffs like beans, pepper and others.
Shehu alleged that the suspect asked the girl to take the soup stuffs inside the house, that he wanted to buy and immediately she entered the house he followed her and asked her to lie on a mattress, he removed her pant and had sexual intercourse with her.
However, she didn’t feel any pain but saw a white liquid substance, the man gave her a rag to clean and a woman came and rescued the girl and took her to her mother and the matter was reported to the Police who took the girl to hospital for medical examination.
The result of the examination shows swollen vulva, tender vaginal wall, with bruises and bridge hymen.
When the case was mentioned yesterday, the prosecution counsel where unable to call their witnesses again, and the presiding judge, Justice Liman said the court is fixed due to non-prosecution of witnesses despite several adjournments.
Justice Liman adjourned the case to 28th March 2018 for definite hearing and no excuse.
