Attorney – General withdraws criminal case against businessman, 2 others

Attorney – General and Commissioner for Justice, Kaduna State has directed the immediate discontinuation of a criminal case between the Commissioner of Police, Yahaya Maikori and two others.
This was contained in letter dated 20th November, 2019 signed by, Aisha Dikko and made available to the media in Kaduna yesterday
The letter which was acknowledged in the office of the Chief Magistrate Court No 3 Daura Road on the 24th January, 2020 stated that section 211 (1) (c) of the constitution of the Federal Republic of Nigeria 1999 (as amended) conferred on her the power to discontinue with the criminal case pending before the Magistrate Court.
It would be recalled that in the First Information Report, dated 6th May, 2019 and reported to the Deputy Commissioner of Police Criminal Investigation and Intelligence Department by Aminu Aliyu against Yahaya Maikori had alleged that, he sold a housing property located at No 5 Keffi road Barnawa Kaduna to one Anzola Resources LTD, sometimes in the month of March, 2019 and served the said suspects and his company with a notice to vacate the property.
However, it was contained in the FIR that the suspects, while parking out of the property vandalized the doors of the house and other valuable items worth Nine hundred and forty-two thousand naira were moved away to an unknown destination.
Meanwhile, the counsel to the complainant, J. A Achimugu had earlier written on behalf of the complainant, Alh. Aminu Aliyu to the Attorney General following the A.G’s request to terminate the First Information Report, F.I.R.
According to the letter addressed to the A.G’s office on the 10th December, 2019 by J. A Achimugu and Co stated that his client “who is the victim of the alleged offences in the F.I.R feels very strongly that the request of the Hon. Attorney General is very strange and denial of justice to him from the fountain of justice.
“The desire to terminate the F. I. R in favour of Yahaya Maikori and two others is clearly designed to aid and facilitate their pending civil suit against our client before the High Court of Justice, No 8 of Kaduna State where they are alleging malicious complaint by our client against them.
“The Defendants who are to be favoured by the request for the termination of the F. I. R have a civil suit against our client rising from the same F. I. R where they are claiming inter Alia the sum of N15M against our client and coming up for hearing on 22rd January, 2020.
“When the Hon. Attorney General wanted to have the parties settle this matter through the Office of the then O/C Legal Police Headquarters, Kaduna, our client did not refuse but Yahaya Maikori never showed up for any settlement.
