The chief magistrate court Buni Yadi, sitting in Damaturu, Yobe state, has arraigned four men, Ibrahim Kontomi,45 years old, Alhaji Goni Adam, 35 years old and Donowu Alhaji Isa, 24 years old and Bukar Mustapha on one count charge of committing an offence against the nature, to wit, homosexuality.
The police prosecutor, Sgt. Hayatu Musa told the court that the case was reported at the state intelligence and investigation bureau, Damaturu on the 29th of June, 2017 by Bukar Alifa together with Mustapha Fajimi, commanders of Sharia committee and Peace Corp respectively, of Goniri village in Gujba local government area of Yobe state.
He told the court that about eight years ago, the first three accused persons Ibrahim Kontomi, Alhaji Goni Adam, and Donowu Alhaji Isa, has sexual intercourse with the fourth accused person, Bukar Mustapha inside his room, located at Goniri village, against the order of nature, that is through the anus.
He told the court that the offence committed by the four accused persons is punishable under section 284 of the penal code law which stipulates that anyone found guilty of such offence should be punished with imprisonment for a term which may extend to 14 years and shall also be liable to a fine..
When the charge against the accused persons were read out and interpreted to them, they all pleaded not guilty to the offence, thus the presiding judge, chief magistrate Aisha A.Ahmed, at the request of the prosecutor, adjourned the case the 3rd of October, 2017, to allow the prosecutor to produce his witnesses to the case.
