2 men sentenced for conspiracy, theft in Yobe

A Senior Magistrate Court 1 in Damaturu, Yobe state, presided over by Asiya Abubakar, has sentenced two men, Isa Mohammed, 20 years old a resident of Nasarawa ward, and Isa Mohammed Jajere, 21 years old and residing in Nasarawa bypass, all in Damaturu, the state capital, on two count charges of conspiracy and theft.
Police prosecutor, Moses Tunjiji, told the court that the two accused persons conspired within themselves and invited two others, one Abba Danji, and One other Abba whose second is unknown, all now at large, and asked these invited ones to go and steal a goat of whatever size at the cost of N3000.00.
He told the court that Isa Mohammed Jajere contributed to the crime by loaning out a tricycle, intentionally unmarked for such purpose of operation, after which the tricycle, having been used to steal a Sumel generator, valued at N200, 000.00, a goat valued at N10, 000.00, and 2 Turkey, valued at N8, 000, was returned to him.
He further told the court that the offences committed by the two accused persons contradicts, and is punishable under sections 97 and 287 of the penal code law.
When the charges against the two accused persons were read out to them before the court, they pleaded guilty to the charges.
The court therefore found them guilty, convicted them accordingly and sentenced them to a fine of N2000.00 each or in default serve four months imprisonment for the first count charge of conspiracy.
They were also sentenced to pay a fine of N4000 each or in default, serve eight months imprisonment of the second count charge of theft.
However, the presiding judge, before passing judgment, and haven found Isa Mohammed to have been previously sentenced for same crime of criminal conspiracy and theft, sentenced him to three months imprisonment with no option of fine, for the offence of unlawful assembly which contradicts section 102 of the penal code law.
